KAMPALA – The Member of Parliament for Makindye SSabagabo, David Sserukenya, has been summoned to court over defamation charges.
Civil Division registrar Jameson Karemani on Thursday summoned the MP to file his defence within 15 days.
The development comes after businessman Frank Kyazze filed the case against Sserukenya at the Civil Division of the High Court.
“You are hereby required to file a defence in the said suit within 15 days from the date of service of summons in the manner prescribed under the civil procedure rules as amended,” he ordered.
The registrar also warned that should the MP fail to file a defence on or before the said date, the plaintiff shall proceed with the suit and judgment may be given in his absence.
The plaintiff’s claim against the MP is for recovery of general damages worth sh300m, punitive and exemplary damages for defamatory statements made in a video and costs of the suit.
Court documents indicate that on January 2022, the MP published a video that aired on Facebook live of Ronald Ssali Mugerwa that Rashida Nabirye mobilised people on her Facebook page to visit the Facebook page of Mugerwa, claiming that the MP was to deliver a message and, indeed, it went live.
The businessman states that he did not watch the live broadcast, but was informed by Mercy Anyango Kasomezo about what was on Facebook.
“Being that Anyango was also not on Facebook, she requested her husband Albert, who has a Facebook account to avail the said video, which he did,” he said.
The plaintiff further asserts that the defendant defamed him, saying all those who failed in the race decided to fight him, but the raging war is between National Resistance Movement (NRM) and National Unity Platform (NUP).
Court documents further indicate that the said video led to a publication in Bukedde Newspaper of January 2022, titled War, MP fights with mobilisers, takes matter to Bobi Wine.
Reputation
The plaintiff says he played football for Uganda Cranes from 1984-1989 currently an ex-international, played professional football for Kampala City Council (KCC) Sports Club (now KCCA F.C) from 1983-1989 and he has been an NRM flag-bearer for Makindye Ssabagabo for the last 20 years.
The businessman adds that in consequence of the said publication, he has been injured in reputation.
He wants an injunction to restrain the MP, his agents and servants from further publishing defamatory statements against him.
